Terms of Service

EVO11VE is a creator and talent network operated by EVO11VING LLC, a Florida limited liability company. We connect brands with creators and talent, produce and coordinate campaigns and content, and provide software tools to brands and creators.

You must be at least 18 years old and able to enter into a binding contract to use the Services. If you use the Services on behalf of a company, you represent that you are authorized to bind that company.

Access to private areas is passwordless: we email a one-time code to the address you provide. You are responsible for keeping access to that email address secure and for all activity that occurs under your account. Tell us immediately at support@evo11veagency.com if you believe your account has been accessed without your permission.

You agree to provide accurate information and to keep it current. We may suspend or close accounts that contain false, misleading or impersonated information.

Agency services: campaigns with creators, content and UGC production, paid advertising, talent sourcing and event staffing, delivered under a quote or statement of work agreed with you.

The Network / EVO Access: a platform where brands can discover creators, review estimated reach and performance signals, and assemble campaign proposals.

Creator Growth Membership: a paid monthly subscription for creators that generates a media kit, a rate card, a Growth Score, an audit and brand recommendations from the information the creator provides.

Not every feature is available to every user, and features may be added, changed or withdrawn as described below.

Agency engagements are quoted individually. The scope, deliverables, timeline and price of each engagement are set out in the proposal, quote or statement of work we agree with you, which controls if it conflicts with these Terms.

Prices shown to clients are all-inclusive: they already incorporate EVO11VE's agency and service fee, together with the amounts payable to participating creators. We do not publish creator rates or our internal cost breakdown.

Unless the applicable quote says otherwise, amounts are quoted in US dollars, are due on the terms stated in the corresponding invoice, and do not include taxes that may apply to you.

Estimates of reach, views, engagement or performance are projections based on historical and public data. They are not promises. Results depend on factors outside our control, including platform algorithms, audience behaviour and the creative itself.

A free tier lets you search the platform and generate a limited number of proposals so you can evaluate whether it fits your needs. Full access is arranged directly with our team and may be granted, limited, changed or withdrawn at our discretion.

Information in The Network, including reach estimates, engagement rates, audience signals and the EVO Score, is derived from public sources and from information supplied by creators. We compile it in good faith but we do not warrant that it is complete, accurate or current, and you should not treat it as the sole basis for a purchasing decision.

Access is granted to you for your own internal business use only.

You may not copy, extract, scrape, download in bulk, index, resell, sublicense, publish, redistribute or otherwise make available to any third party the creator database, profiles, contact details, rates, scores, metrics or any other compilation that forms part of the Services, whether in whole or in part, and whether by automated means or manually.

You may not use the Services to build, train or improve a competing database, product, model or service, and you may not circumvent or attempt to circumvent any access control, rate limit or technical restriction.

You may not use creator contact information obtained through the Services to contact creators outside the Services in order to avoid EVO11VE's involvement in an engagement that originated on the platform.

This section survives termination of your access. Breach of it causes harm that money alone may not remedy, and we may seek injunctive relief in addition to any other remedy.

The Creator Growth Membership is a subscription billed at US$39 per month, unless a different price is shown to you at checkout. By subscribing, you authorize us and our payment processor to charge your payment method automatically on each billing cycle until you cancel.

The subscription renews automatically. Prices may change; we will give you notice before a changed price applies to a renewal, and you may cancel before it takes effect.

You can cancel at any time from your member dashboard or by writing to support@evo11veagency.com. Cancellation stops future charges and takes effect at the end of the period you have already paid for; your access continues until then.

Except where required by law, payments already made are non-refundable, including for periods you did not use. If a payment fails, we may suspend access to member features until the payment is completed.

The membership produces documents and analysis from the information you supply, which may include a media kit, a rate card, an audit, a Growth Score, monthly objectives, suggested brands and other materials. What is included may change as the product evolves.

The Growth Score is a proprietary indicator calculated from the metrics available to us at that moment. It is an internal reference tool, not a valuation, a certification, or a guarantee of quality, income or opportunities.

Suggested rates are orientation based on comparable market data. You set your own prices and are solely responsible for what you charge and for the commercial agreements you enter into.

The membership does not guarantee bookings, brand deals, income, audience growth or any particular outcome. It gives you tools and information; results depend on you and on factors we do not control.

Documents are prepared for your own professional use. You may share them with brands and agencies. You may not resell them, present them as the work of a third party, or use the EVO11VE name and marks to suggest a partnership, endorsement or representation that does not exist.

Parts of the membership, and some tools available to brands, are generated with the assistance of automated systems and artificial intelligence models, working from the information you provide and from public data.

Automated output can contain errors, omissions or outdated information. You are responsible for reviewing anything you publish or send to a third party before using it. We do not warrant that generated content is accurate, complete or fit for a particular purpose.

You should not treat automated output as professional, legal, financial or tax advice.

You may choose to connect an Instagram account, or another supported platform, so that we can read metrics associated with it and use them to prepare your materials. This connection is optional and requires your explicit authorization through the platform's own permission screen.

We access only the data covered by the permissions you grant. You can disconnect at any time from your dashboard or from the settings of the platform in question; from that point we stop retrieving new data. Information already incorporated into documents you have generated remains in those documents.

Access to third-party platform data depends on those platforms and on their approval of our application. Availability, scope and functioning may change, be limited or be interrupted by decisions of those platforms, and that is outside our control.

You are responsible for holding the rights over the connected account and for complying with the terms of the platform in question.

From time to time we may run promotions or giveaways for active members of the Creator Growth Membership, with prizes we announce on the corresponding occasion.

No additional purchase is required to enter beyond holding an active membership at the time of participation, and participation is voluntary. Where a promotion has its own specific rules, those rules are published with it and prevail over this section for that promotion.

Employees and contractors of EVO11VING LLC and their immediate family members are not eligible. Prizes are personal, non-transferable and may not be exchanged for cash unless we state otherwise.

We may modify, suspend or cancel any promotion, and substitute a prize for another of equal or greater value, particularly if it cannot be delivered for reasons beyond our control. Any tax arising from receiving a prize is the responsibility of the winner.

Promotions are void where prohibited or restricted by applicable law.

Membership in The Network is non-exclusive and does not guarantee bookings, income or specific opportunities. You participate as an independent contractor, not as an employee of EVO11VE.

Where you are booked for paid work coordinated by EVO11VE, payment is made according to the terms agreed for that engagement, typically after EVO11VE has received the corresponding client funds.

Use of your name and image: by applying to or joining The Network, you grant EVO11VE a worldwide, non-exclusive, royalty-free license to use your name, handles, profile information and images (including images you provide and your public profile photos) on the EVO11VE website, within The Network, and in marketing and promotional materials, in order to promote the network and the Services. This permission does not transfer ownership of your content.

You may request that your profile be updated or removed, or that we stop using your image in future materials, at any time by writing to support@evo11veagency.com.

You keep ownership of the content, images, metrics and materials you provide. You grant us a license to host, process, adapt and display them as needed to operate the Services and to deliver what you have requested.

You represent that you hold the necessary rights over everything you upload, that it does not infringe third-party rights, and that any person appearing in it has consented to its use.

The Services, including the website, its design, the EVO11VE name and marks, The Network, the Growth Score and EVO Score methodologies, the document templates, and all compiled data and content, are owned by EVO11VING LLC or its licensors and are protected by intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable and revocable right to use the Services in accordance with these Terms. Nothing in these Terms transfers ownership of anything to you.

You agree not to use the Services to break the law, infringe third-party rights, upload malicious code, impersonate another person, harass anyone, send unsolicited communications, or interfere with the operation or security of the platform.

You agree not to attempt to access accounts, data or areas you are not authorized to access.

The Services rely on third-party providers for payments, messaging, hosting, analytics and data processing, and may contain links to sites we do not operate. We are not responsible for the content, practices or availability of those third parties, and their use is governed by their own terms.

Payments are processed by an external payment provider. We do not store your full card details.

We work to keep the Services available, but we do not guarantee uninterrupted or error-free operation. There may be interruptions for maintenance, updates, failures of third-party providers or causes beyond our control.

We may add, modify, limit or discontinue features, products or plans at any time. Where a change materially and adversely affects a paid subscription you hold, we will give you reasonable notice and you may cancel.

We may set reasonable technical limits on use, such as request or generation limits, to protect the operation of the platform.

We may suspend or terminate your access, immediately and without prior notice, if we reasonably believe that you have breached these Terms, that your use puts the platform, our clients or the creators at risk, or that there is fraudulent or unlawful activity.

You may stop using the Services at any time and request the closure of your account by writing to support@evo11veagency.com.

On termination, the rights granted to you cease. The sections on restrictions on platform data, intellectual property, disclaimers, limitation of liability, indemnification and governing law survive.

The Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the data, metrics, estimates, scores or recommendations offered through the Services are accurate, complete or current, nor that the Services will meet your expectations or produce any particular commercial result.

To the maximum extent permitted by law, EVO11VING LLC and its members, officers, employees and contractors will not be liable for indirect, incidental, special, consequential or punitive damages, nor for loss of profits, revenue, data, goodwill or business opportunity, arising out of or in connection with the Services.

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Services is limited to the amount you actually paid us in the three (3) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless EVO11VING LLC and its members, officers and contractors from any claims, damages, liabilities and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your content, products or campaigns, or your breach of these Terms or of any applicable law.

We may update these Terms. We will change the date at the top and, where the change is material, we will give notice through the Services or by email. Continuing to use the Services after a change takes effect means you accept the updated Terms.

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. Before filing any formal claim, you agree to first contact us at support@evo11veagency.com and attempt to resolve the dispute informally for at least thirty (30) days.

Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida, and you consent to venue there.

If any provision of these Terms is held invalid, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or transfer of the business.

These Terms, together with any quote or statement of work agreed with you, constitute the entire agreement between you and EVO11VE regarding the Services.
